Terms of Service

These terms are an agreement between you and Misto Design House Ltd ("we", "us"), a company registered in England & Wales with its registered office at C/O Unit 4, Kinetica, 13 Ramsgate Street, London, England, E8 2FD, for your use of the Dare app. By using Dare, you agree to these terms. If you don't agree, please don't use the app.

What Dare is

Dare is an accountability tool. You set a daily goal and choose apps to put "on the line." If you miss the goal, Dare uses Apple's Screen Time to lock those apps until you make it up. The goals available are a daily step count, daily exercise minutes, a daily active-calorie target, and a bedtime (your chosen apps lock from bedtime until your wake time). You can set a different target for each day of the week, and choose which days count at all. Dare is not a medical, healthcare, coaching, or fitness-advice service.

Eligibility

You must be at least 16 years old to use Dare.

Your account

Dare creates an account so your data can sync. You may sign in with Apple or Google. You are responsible for keeping access to your sign-in method secure. You can delete your account and all associated data at any time from within the app.

App locking and your responsibility

Dare restricts access to apps you choose, using Apple's Screen Time framework, when you miss a goal, and, if you set a bedtime goal, during the hours you chose. You are responsible for the apps you put on the line. Do not lock apps you may need for work, safety, health, accessibility, or emergencies. Emergency calling on your iPhone is not affected by Dare. Dare is a motivational tool and must not be relied upon for anything safety-critical. App-locking behaviour depends on Apple's Screen Time functioning as designed on your device, which we do not control and cannot guarantee.

Health disclaimer

Dare does not provide medical or fitness advice. You choose your own goals, and you are responsible for choosing goals that are safe and appropriate for you, including any bedtime you set. Consult a qualified professional before starting or changing any exercise programme, or if you have concerns about your sleep. You participate in any physical activity at your own risk. Goal verification relies on data from Apple Health and your device sensors, which may be inaccurate or incomplete; we do not guarantee its accuracy.

Subscriptions and billing

Dare is free to use, with an optional paid upgrade. The free version keeps one active goal, its full history, and locks you can dismiss. Paid unlocks additional goals, locks with no escape, longer lock durations, and blocking whole app categories.

Dare offers auto-renewing subscriptions and may offer a one-time purchase. Purchases are processed by Apple through your App Store account, and are governed by Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage or cancel your subscription in your App Store account settings; you cannot cancel through us. Any free trial converts to a paid subscription unless cancelled before it ends. Except where required by law or by Apple's policies, payments are non-refundable. Refund requests are decided by Apple. When you request one, you consent to us sharing basic consumption information with Apple (whether the purchase exists in our records and whether the paid features were delivered) to help Apple decide. This never includes your health data, goals, or locked apps. See our Privacy Policy for details.

Lifetime purchases. A lifetime purchase grants access to Dare Pro for as long as Dare is offered, with no recurring payment. It is a licence for the life of the app, not a promise that the service will exist indefinitely. If we ever discontinue Dare, we will give reasonable notice and use reasonable efforts to leave the app functional on your device, including keeping Pro features unlocked in the final version.

Earning a free month

Dare includes a reward for using it as intended. If you are on a yearly subscription and you meet every one of your goals for four consecutive full weeks, you can claim one free month. You may earn up to three free months per subscription year.

Some details worth being plain about:

  • A week only counts if each of your active goals was met on every day it was scheduled, and the target you set was at least the target Dare suggested from your own recent activity. Lowering your targets to collect the reward will not work; weeks below that bar do not count, and the app tells you when that is the case.
  • A paused week (a "rest week") neither counts toward the four nor breaks your run.
  • The reward is fulfilled by us, by hand, after you claim it. On a yearly subscription it is applied to your account as a free month. On a lifetime purchase, where there is no renewal to discount, it is issued instead as a promotional code you may pass to someone else. It is not applied automatically, and there may be a short delay.
  • It has no cash value, cannot be exchanged or refunded, and is not available on monthly purchases. A reward earned on a lifetime purchase is issued as a code you may give to another person; a reward applied to a subscription is tied to that account and is not transferable.
  • This is not a free trial, a prize, a competition, or a game of chance. Whether you earn it depends only on whether you did the thing you said you would do.
  • We may change or withdraw this reward for future periods. Anything you have already earned will still be honoured.

We may decline a claim where the underlying activity data appears to have been manipulated, or where the same person is claiming across multiple accounts.

Acceptable use

Don't misuse Dare: don't attempt to break, probe, or circumvent its security or its verification/anti-cheat systems, don't use it unlawfully, and don't interfere with other users or our infrastructure.

Intellectual property

Dare, including its name, logo, design, and software, belongs to Misto Design House Ltd. We grant you a personal, non-transferable, revocable licence to use the app under these terms. Your data remains yours.

Disclaimers

Dare is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, and we do not warrant that the app will be uninterrupted, error-free, or that locks or verification will always work as intended.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect or consequential losses, or for loss arising from your choice of goals or the apps you lock. Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Your statutory rights as a consumer are not affected.

Termination

You can stop using Dare and delete your data at any time. We may suspend or end your access if you breach these terms or misuse the app.

Changes to these terms

We may update these terms as the app evolves. We'll update the date above and, for material changes, notify you in the app. Continuing to use Dare after a change means you accept the updated terms.

Apple

Dare is licensed to you, not sold. This licence is subject to Apple's Licensed Application End User License Agreement. Apple is not responsible for the app or its content and has no obligation to provide support or handle any claims relating to it; Apple is a third-party beneficiary of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of England & Wales, and disputes are subject to the courts of England & Wales.
